What is happening to the case of Rahmady Effendi Hutahaean since his first investigation in May 2024?

Rahmady Effendi Hutahaean is the former Head of the Customs Office in Purwakarta, West Java. He was dismissed from his position on May 9, 2024, by the Ministry of Finance after an internal investigation found indications of a conflict of interest and abuse of authority involving his family.

He was in charge in Port of Tanjung Balai, Batam, and Balikpapan customs. Rahmady Effendi Hutahaean, during his tenure as Head of the Customs Office in Purwakarta, was suspected

of using his position to facilitate import activities for PT Mitra Cipta Agro, a company linked to his wife, Margaret Christina Yudhi Handayani Rampalodji. Margaret served as the company's President Commissioner and she is also the owner of share of the company since 2017. Rahmady’s involvement in smoothing the import process for this company raised concerns of a conflict of interest and abuse of authority. As a result of these allegations, the Ministry of Finance dismissed Rahmady from his position on May 9, 2024, to facilitate further investigation.

Rahmady was also reported to the Corruption Eradication Commission (KPK) by lawyer Andreas from Eternity Global Law Firm for allegedly failing to accurately report his assets in his State Official Asset Report (LHKPN).

In the 2022 LHKPN report, Rahmady declared assets totaling IDR 6.39 billion, up from IDR 5.65 billion the previous year. However, Andreas suspected that Rahmady actually possessed assets worth up to IDR 60 billion that were not reported in the LHKPN, including a 500-hectare palm oil plantation in Muaro Jambi. Rahmady denied the allegations and claimed the report was an attempt to twist the facts.

Based on the latest State Officials Wealth Report (LHKPN) submitted on February 22, 2023, Rahmady Effendy Hutahaean (REH) declared total assets worth approximately IDR 6.4 billion. His reported assets include land and buildings valued at IDR 900 million (including properties in Surakarta and Semarang), vehicles worth IDR 343 million (including a 1981 Toyata Hardtop Jeep, a 2017 Honda CR-V, and a 2017 Honda motorcycle), and financial assets such as moveable property valued at IDR 3.28 billion, securities worth IDR 520 million, cash and cash equivalents of IDR 645 million, and other assets totaling IDR 703 million. This raises concerns about the accuracy and completeness of his wealth declaration, contacting the Corruption Eradication Commission (KPK) or the Directorate General of Customs and Excise is recommended.

Here are the alleged assets owned by Rahmady that are suspected to be unreported or not declared in the LHKPN:

  • Ownership of a house with a swimming pool in the prestigious Kemang district.

  • Issuance of a loan amounting to IDR 7 billion to a company in 2017, reportedly through his wife acting as a nominee.

  • Ownership of a 500-hectare palm oil plantation in Jambi.

  • Funding the education of his three children at expensive private schools in Jakarta.

  • Employing three full-time domestic workers at his residence.

The evidence

  • Mr Effendi acknowledges and declares that he was able to facilitate the import process, even up to the city of Medan, the Head Office, and met with the Director of Customs who was in office at that time in order to smooth out the entire fertilizer import process for PT MCA. This action can be categorized as an abuse of authority.

  • This action violates the provisions of Article 4 of Government Regulation Number 94 of 2021, which states that civil servants are allowed to run businesses, but as ASN (State Civil Apparatus), they must prioritize their main duties. It also violates the Civil Servants’ Code of Ethics as regulated in Government Regulation No. 42/2004, by committing abuse of authority and accepting rewards or gifts related to his position and/or work. e

CONCLUSION

(The following matters have also not yet received attention from the West Jakarta District Court and Prosecutor’s Office)

A. In 2017, Margaret Christina Yudhi Handayani Rampalodji was appointed as the Chief Commissioner of PT. Mitra Cipta Agro, as the nominee of Rahmady Effendy Hutahaean.

B. PT Mitra Cipta Agro, as the borrower, is obligated to pay interest amounting to IDR 75,000,000 to Mr. Rahmadi Effendi Hutahaean as Monthly Income. This obligation is fulfilled monthly, and they have classified these payments as "salary."

C. Mr. Rahmadi Effendi Hutahaean claims that his efforts to facilitate the goods were solely to support the joint business with his wife, which can be considered a service claimable to PT Mitra Cipta Agro. These efforts included traveling to areas outside of his official jurisdiction in Medan, meeting with the Director, and "putting himself on the line" for the benefit of the company.

D. Margareth Christina Yudhi Rampalodji is a housewife with 3 children, and hardly been to office (less than 5 times in all those years (2017–2023) she became aggressive in calling for a meeting in October 2023 and filed a report to the Metro Jaya Regional Police in November 2023 because the business has grown tremendously.
